29 Mar 2010We’ve written about Farmer’s Branch, Texas since 1996, when they first passed an ordinance effectively banning the existence of undocumented families by making it a crime to rent to them. The Texas town is in the news again with a second federal judge coming down with a decision stating that the ordinance is unconstitutional.
U.S. District Judge Jane Boyle of Dallas ruled Wednesday that the ordinance was an attempt to enforce U.S. immigration laws – something the judge said only the federal government can do.
The judge also issued a permanent injunction to stop Farmers Branch from enforcing Ordinance 2952.
This is the second time that a judge has ruled against the law which denies people the right to live where they choose but probably not the last we will hear about it since Mayor Tim O’Hare (sounds like an immigrant name no?) has vowed to appeal.
We all know the federal government has been enforcing immigration laws, since we have seen detentions and deportations go up under Obama.

We’ve written a couple of times about Farmers Branch, Texas, and the quest of some there to make discrimination against undocumented immigrants city policy. In addition to attempts to make English the “official” language of the city, legislation was proposed which would impede landlords from renting to the undocumented. Voters in the town supported discriminatory law, pushing it to approval with 68 percent voting in favor, but at the urging of MALDEF and attorneys for landloards, a federal judge said “no”:
U.S. District Judge Sam A. Lindsay wrote in granting a temporary restraining order that only the federal government can determine whether a person is in the United States legally.

A campaign to boycott the opening of a grocery store catering to Latinos is heating up in the town of Farmers Branch, Texas.
Farmers Branch residents have been urged in unsigned leaflets delivered to their homes to oppose alleged plans for a grocery store which would cater to the city’s Latinos.… It is unsigned asking neighbors to call Minyard Food Stores to tell them people don’t want a Carnival food store to fill the empty shell on Josey Lane – Carnival is the Minyard’s brand that caters to Latino tastes.
This attempt to discourage immigrant-related businesses wanting to open up in Farmers Branch comes on the heels of another initiative there which sought to “ban illegal immigrants” and make English the official language of the city.
