22 year old Pedro was brought to the United States from Mexico when he was 7 years old by his grandmother, who raised him. The young man, who lives in Arizona and has no living relatives on either side of the border, has been told that he has until Tuesday to report to Immigration and Customs Enforcement, who could deport him.

This past Saturday The DREAM Act failed to pass a procedural cloture vote 55-41. While most of the votes against moving forward to actually debate and vote on DREAM were Republicans, there were Democrats who also voted against the DREAM Act including Montana Sen. Jon Tester, who called DREAM, “amnesty”. Other Democrats who helped the DREAM Act die in this Senate session are Ben Nelson, NE; Max Baucus, MT; Mark Pryor, AK and Kay Hagan, SC. There were, on the upside, some Republicans who voted for the DREAM Act. Those were Bennett (UT), Lugar (IN), and Murkowski (Alaska).
Let the Finger-Pointing Begin
As mentioned above, Democratic senators blamed the Republican Senators, especially ones who supported DREAM in the past, senators like Sen. Orrin G. Hatch. President Obama blames the GOP. Most pro-immigrant orgs have released statements blaming the Republicans. A handful of bloggers have noted that had the 5 Democrats mentioned above voted yes, the 60 votes mark would have been reached. There is discussion about if the White House pushed hard enough and if progressive organizations outside the immigration and Latinosphere did enough.
What’s Next
Let’s be real, there were/are some who declared the DREAM dead even before this last Senate cloture vote. There were some who felt that the vote was a useless show. The DREAMers are heartbroken and angry and the big question for them is where they go from here as individuals and in the wider movement(s). Even before this last failed vote, Congressman Luis Gutierrez announced pressing Obama to sign a moratorium on detentions and deportations. There is some indication that some DREAMers may push for something like this as well with a focus on those like them, those brought hto the U.S. as children. There are some calls for the renewal of movement towards Comprehensive Immigration Reform.
Legislatively speaking, DREAM and anything remotely looking like CIR doesn’t seem likely. The CIR plans that came out over the last few years, pushed by Democrats were laden with pre-enforcement efforts. Imagine what CIR proposals with a Republican Congress would look like?
Some have set there eyes into the future, 2012, promising to vote out those who didn’t vote for them but in the meantime what?
I am not an undocumented immigrant. I am not an immigrant. My stake and my decision making power is not important here. What is important is working in the streets and in our communities to make sure that the lives of immigrants are protected. I fully expect things to get harder before they get easier. So the challenge I put out there for myself and for others, is what will people do to make sure that immigrant communities and the families within then are protected, educated and healthy? I am not talking policy. Policy will not, can not, and does not save our lives. We will, we can, and we have to.

At 9 a.m. EST the debate will begin and will be airing live on CSPAN. The cloture vote, which is a procedural vote to move forward, is expected to happen around 10:30 a.m.

17 Dec 2010Late yesterday, Senate Majority Leader Harry Reid filed cloture on the DREAM Act and the repeal of Don’t Ask Don’t Tell (DADT) meaning that cloture votes are slated to happen on Saturday morning in the order presented above. If DREAM gets 60 votes on Saturday morning, then there can be debate and amendments presented. The actual vote on the DREAM Act could then potentially happen on Monday morning.
The Senators to target by calling (202) 224-3121 hasn’t really changed from yesterday, but there are some Senators that really do need to know that the community has their eyes on how they vote on this and that their vote on DREAM will not be forgotten. Senators that need some extra pressure include LeMieux, Hutchison, Hagan, McCaskill, Landrieu, Brownback and Voinovich.
For those who think that calls do not work, bochinche has it that formerly undecided Democratic Senator Dorgan of North Dakota is now most likely a yes vote.

16 Dec 2010While some mainstream media outlets continue to issue obituaries for the DREAM Act, Latino celebs are coming out in favor of it.
Reggaetoneros Wisin y Yandel have been tweeting their support for the DREAM and urging fans to call Senators to vote.
Ozomatli y Ugly Betty actress America Ferrera have lent their names and star power behind a petition sponsored by the National Council of la Raza (NCLR).
Edited at to add that apparently singer José José has also come out in favor of DREAM.
Mexican rockeros Maná issued a press release two days ago announcing their support for the DREAM act. Lead vocalist Fher is quoted as saying:
Es vital que estemos alertas, que no nos quedemos cruzados de brazos en espera del resultado de la votación en el Senado; como les decía: que todos los latinos envíen cartas, correos, emails, que llamen por teléfono a los senadores y a las oficinas de los partidos. La Cámara de Representantes ya nos dió la señal de que SI SE PUEDE. La aprobación del “Dream Act” corrige una de las peores fallas de un sistema de inmigración con muchos problemas donde se obliga, a los jóvenes que han crecido en los Estados Unidos hablan inglés, sobresalen en sus comunidades, en la escuela como deportistas o voluntarios, a poner su vida y su talento en receso porque los consideran ilegales. Es cierto, eso tiene un precio muy alto para nuestros hermanos y para sus familias, pero también para los Estados Unidos.

14 Dec 2010I wanted to write up a quick update since peeps on various social networks have reached out asking what is up with the DREAM Act. Mainstream media, including CNN and the Washington Post (yes, I am naming names) have come out with obituaries for the DREAM Act. However, I am hearing that a DREAM Vote in the Senate WILL HAPPEN and it looks like it will happen early next week. As we move along this week things will become more clear.

9 Dec 2010The procedures behind what went down in the Senate today around the DREAM Act is complicated and confusing. So I will try my best to explain what went down.
Senator Reid twice asked to vitiate the vote on cloture which means to set it aside. This was objected to, twice. So then Reid moved to table the vote, which means means killing the Senate version of the DREAM Act so that the House version, which passed last night, CAN be voted on later. This motion to table passed, 59-40. We are not sure when vote on the House version of DREAM in the Senate will happen. Most likely it will be next week.
All in all this gives DREAM a better chance in passing, especially when considering that there are Senators on the fence who do not want to be targeted and be in the spotlight twice. And obviously this gives advocates, activists, and you more time to call and ask that DREAM be supported.

While D.C. is focused on the DREAM, in NY today, eyes shift to a different but equally important immigration matter : the criminalization of migrants and the merging of local police with Federal enforcement efforts.
This morning, at the same time that a cloture vote on DREAM is expected in the Senate, there is going to be a rally in front of Governor Paterson’s Manhattan office today to demand rescission of New York’s agreement with Immigration and Customs Enforcement (ICE) to bring a deportation program called “Secure Communities” to New York State.
With no public input, New York’s Division of Criminal Justice Services signed an agreement with ICE in May this year to bring Secure Communities to New York. Under the program, law enforcement agencies in the state are required to automatically forward to federal immigration databases the fingerprints of every arrested person. Undocumented immigrants, US citizens, and lawful permanent residents alike are subject to these database checks. Based on often unreliable and incomplete information, ICE then transfers people suspected of being deportable directly into the detention and deportation system, separating them from their families and communities.

8 Dec 2010No really. The House of Representatives just passed the DREAM Act, Development, Relief, and Education for Alien Minors Act of 2010 (DREAM Act, H.R. 6497) with a 216 to 198 vote.
I caught the last few minutes of the C-Span live stream and my heart was racing watching the number slowly get to 210, the number needed to pass, then reach 216. And I won’t front. Mala cried. I cried holding close to my heart all the DREAM Activists that I have met, broken bread with, spoken with, shared wine with and become friends with. I think of the DREAMers who are no longer here and those to come.
But now pa’lante. Tomorrow the DREAM is up for a vote in the Senate.
