Whew. This story takes the “I can’t tell you people apart” logic to a new level. A man born in Puerto Rico (for the uninformed–that means he’s a US citizen) was recently detained for three days and threatened with deportation–to Mexico.

From Huffington Post:

Eduardo Caraballo, a U.S. citizen born in the United States, was detained for over three days on suspicion of being an illegal immigrant.

Despite presenting identifying documents and even his birth certificate, Caraballo was held by federal immigration authorities over the weekend and threatened with deportation, according to an NBC Chicago report. He was only released when his congressman, Luis Gutierrez — a vocal supporter of immigration reform — intervened on his behalf.

Now, we here at VL have been told repeatedly that the SB 1070 legislation is not racist. And that if on the off chance that a legal person *is* pulled over, that person has nothing to worry about. Because all you need to do is show your documents and everything will be ok. Right?

But what happens when the word of person producing the documents is brown? What happens when the person producing the documents is considering inherently illegal? Inherently devious and untrustworthy?

There are no papers official and legal enough to prove to people who don’t want to hear it that indeed, you are legal. We only have to look at President Obama for proof of that.

So what are those of us who are illegal no matter what papers we have to do? Are we supposed to trust the system? Just trust that people who will never and have never had their legality center on a piece of paper will “do the right thing” when *their own paper work* proves them wrong?

The other day I wrote about a gay Latino was assaulted here in NYC and after going to the police found himself facing criminal charges and deportation. Ricardo Muñiz’s mother spoke at a press conference in front of the Brooklyn Supreme Court.
The video, from Univision is in Spanish pero I will translate after.

Mala’s translation:
Anchorwoman: A Latina mother says that her son was savagely beaten for being gay and that when he went to press charges, he was the one that ended up behind bars and now could be deported. From New York, Natalia Cruz gives us more details on this case.

Natalia Cruz: With tears, this Mexican mother begs for her son not to be deported.

Jorgelina Aguirre: My son is unjustly in jail, just because he is homosexual. They took all these things to use against him.

Natalia Cruz : The mother says that her son, 23 year old Ricardo Muñiz, went to press charges saying that he had been savagely beaten for being homosexual. The police, allegedly according to Muñiz’s mother, painted Ricardo as the villain.

Jorgeline Aguirre: We came from my country because they would attack him. They discriminated against him. They would beat him. It was never like this though.

Natalia Cruz : Muñiz told the police that last July 18th, he was dancing with a friend in an area bar and there two men starting screaming anti-gay insults at them. When Muñiz walked out on the street with two friends, the alleged aggressors intercepted them with their car.

Karina Claudio from Make the Road NY [full disclosure, I know Karina]: The men got out of the car and started to insult Muñiz and his friends again.

Natalia Cruz: According to Muñiz, he was attacked with fists, a bat, and a belt buckle. However, the alleged attacker, who appears in reports as Jose Cruz, is listed in papers from the District Attorney’s office as the victim. Cruz says that Muñiz and other men attacked him. Cruz was taken to a hospital and put in an induced coma. Jorgelina asks the the case be cleared and the charges dropped against her son.

The police confirmed that Muñiz was arrested August 6th of last year with 4 assault charges, one in the first degree. Muñiz returns to court May 5th. In the meantime, his friend, Danny Valdez, who was also arrested for the incident, was already deported to his country, El Salvador, according to the Brooklyn District Attorney’s Office

20090313elpgal_2For a change from the posts about raids and militarized borders, an immigration story with a very happy ending.

It happened in Spain, a country with an “immigration problem” like the U.S., but where people as a whole tend to be a lot more likely to look at immigrants as people rather than “problems”. Hassane Moctar, at 21 years old, arrived by night on a makeshift raft to Spain from Mauritania, taking his life into his own hands to try to find a better life in Europe. He ended up in Galicia, where a family from Cangas do Morrazo, a town near Pontevedra “adopted” him. Hassane has been living with the Veiga family for 6 months, and the family who were once strangers now consider him part of their family.

But things weren’t so rosy with Hassane’s legal situation. Two weeks ago, Hassane, now 24, went to court to answer to a deportation order which would send him back immediately if something wasn’t done. His attorney demonstrated that the people of Cangas supported him, that he spoke Spanish, and that he even had job offers. The Veiga family began a signature campaign and managed to collect 5,000 names from townspeople in support of Hassane staying in Spain. His Galician “sister” testified on the stand to the fact that he was now part of the Veiga family:

“Ever since he started living with us, he’s been just like any member of the family. He’s never had any problems and we all love him. My 95 year old grandmother asks where Hassane is as soon as she gets up, and he spends a lot of time with her. If he gets deported, my grandmother will die.”

But initially much of this was considered irrelevant to his case by the judge. Now he had to wait for the verdict.

The Last Hurrah for Immigrant Hating Adminstration

image4622658l.jpgAttorney General Michael Mukasey left us, especially immigrants, a parting gift, so that they don’t start this new year and new presidential administration with any false ideas of where their place is: deported.

In a decision issued Wednesday, January 7, the Attorney General declared that henceforth, immigrants, asylum seekers, and all others in removal (deportation) proceedings do not have any right under statute or the Constitution to representation by a lawyer before they can be ordered deported. The Board of Immigration Appeals (BIA) and most federal courts have for decades operated under the premise that immigrants DO have such rights. The Attorney General has reversed many years of precedent and operation by simply declaring it so.

According to the Attorney General, because there is no legal or constitutional right to a lawyer, immigrants do not have the right to legal counsel and thus no right to complain or request a new hearing when their lawyer is incompetent or fraudulent. The Attorney General does attempt to ameliorate the harsh impact of his revolutionary action by allowing reopening of cases in certain highly extreme circumstances, but his declaration will wipe out the rights of all but a handful of people with one stroke of his pen.

I.C.E Gets Served…..Deportation Papers

ice.jpgAy if only life would imitate art/activism and we could really boot those who terrorize and break human rights laws and the laws of simple humanity. The creative and bold move by FIRE is an example of ways people can defend their right to exist and confront those that strive to keep power.

From Nezua:

Flagstaff. AZ — At approximately 10AM on Thursday December 4th, Flagstaff Immigrant Rights Enforcement (FIRE) confronted Immigration and Customs Enforcement (ICE) in a daring raid, serving a notice of deportation to ICE representatives at an ICE Management meeting. FIRE agents pinpointed the location of the ICE management
meeting at the Flagstaff Radisson Hotel in the Kaibab Meeting Room and staged the raid. FIRE agent Del Fuego read the notice of deportation to more than 15 ICE associated criminals, some of whom appeared to possibly be illegal immigrants themselves, as they were not Indigenous People. Agent Del Fuego called for the immediate withdrawal of ICE from the Flagstaff community and notified ICE of the cease and desist order for all future raids.

DIY Deportation Plan Not Really Working

ICE%20raid%20santa%20ana%20calif%20jan%2017%202007%20ap%20photo%20mark%20avery-thumb.jpgLike a page ripped from The Onion: ICE’s new deport-yourself plan isn’t such a hit among undocumented immigrants. Surprisingly, people who have risked their lives and left their families behind to have a better life on U.S. soil are reluctant to leave. How about that?

That invitation drew hardly any takers Tuesday on the first day of a new federal “self-deportation” program that offered 457,000 eligible illegal immigrants the chance to turn themselves in, get their affairs in order and leave the country without being detained.

The tepid response only reinforced doubts about an idea that has drawn criticism and even ridicule from both sides of the immigration debate.

“You would have to be crazy — who would want to turn themselves in?” said Angel Martinez, a construction worker who waited Tuesday outside ICE’s Charlotte, North Carolina, office while his son visited a friend detained on immigration violations.

Indeed, Mr. Martinez. I’d like to know who the knucklehead behind this idea was. I think we could have saved the government the few million they’ve likely spent if they would have bounced the idea off of us first.

New ICE Policy Wants Undocumented to Raise Hands and Self-Deport

raise%20your%20hand.jpgTo me this is the stupidest idea ever and the worst attempt at trying to play nice and act as if they are compassionate. Immigration and Customs Enforcement aka ICE’s Director announced on Sunday Operation Scheduled Departure.

The announcement of the program by Julie Myers, on Univision’s popular show ‘Al Punto’ con Jorge Ramos, is considered unofficial, as the program which asks undocumented immigrants without prior criminal records to turn themselves in to ICE to be deported, has yet to be announced or mentioned in an official capacity or through any other media outlet.

The benefit to the undocumented? ICE will be nice enough to not put the immigrants in a detention center and will give the immigrants a few weeks to get their affairs in order (like figure out who the leave the children they will be forced to leave with?)

Aww isn’t ICE nice?

yellow_austin_dwntwn_small.jpgWay back in 2005, we told you about a market phenomenon that was occurring as a result of increased Latino immigration: more taxicabs. Back then, it seemed that the reason for the boom in taxis in cities like Houston, Texas, was the fact that many newly arrived immigrants don’t have cars. Now the phenomenon has repeated itself in Georgia, and locals point to a more compelling reason: harsher laws are driving some to avoid driving for fear of being picked up and deported.

In the past month, taxicab companies have seen an increase in business by as much as 30 percent — a direct result, owners say, of a new law enforcement initiative targeting immigration violations.

The initiative, a local-federal partnership known as 287(g), was implemented in April by the Hall County Sheriff’s Office. It allows detention officers to begin deportation proceedings for any arrestee who is brought to the county jail and determined to be in the country illegally.

Sheriff Steve Cronic has said that the initiative has already cut down on the number of arrests for common traffic offenses such as driving without a license.

Some cab drivers in Gainesville are saying that the effect of the law has been such that traffic has been notably reduced on freeways, as more immigrants choose to cab it over driving.
