30 Oct 2010While the Tea Party and the candidates they support constantly twist the U.S. Constitution to fit their agenda, the current administration seems to have it’s own constitutional issues especially with how it treats those suspected of being undocumented.
On October 20th Immigration and Customs Enforcement conducted a raid at The Clairmont, a South Nashville, Tennessee apartment complex. As is the usual line, the raid was supposed to target the “dangerous” or “bad” undocumented, in this case alleged “gang” members from MS-13 and SUR-13.
From the Tennessean:
“In this case, ICE’s Fugitive Operations Team was assisting local law enforcement with field interviews of suspected street gang members and targeted ICE fugitives,” said ICE spokesman Temple Black from the New Orleans field office.
Except residents and advocates have a different perspective.
According to the American Civil Liberties Union, 20-40 people were detained.
“ICE came in — from the allegations that we heard — without consent, breaking into people’s homes, breaking through windows and doors, dragging people out by gunpoint and in front of children. We are not aware of a single criminal charge that has resulted from this raid that terrorized all of these people,” said Tricia Herzfeld, an attorney with the ACLU.
A joint press release from the ACLU and The Tennessee Immigrant and Refugee Rights Coalition reports that racial epithets were yelled at women and children, interrogated a 13-year-old child, and detained an elder diabetic.
Additionally some advocates are charging that the raid was an act of retaliation by landlords who did not want to deal with complaints of poor conditions by tenants. At the time of the raid, the apartment complex was already under investigation for deplorable living conditions. Among the problems reported are water leaks, lack of essential services, mold problems and widespread pest infestation. Several buildings have had limited or no water supply and no heat for months.
