Telefutura’s Escándalo TV reported today about Shakira’s unexpected no-show at the ceremony for Spain’s Academy of Music Arts and Science awards. They showed a video of a Shakira herself saying something like “I’m really sorry I couldn’t be in Spain, but we’ve had to cancel some dates” et al. Cut to a reporter asking a Sony Music rep at the awards why Shakira wasn’t there and he answered that she had cancelled at the last minute because she was sick.
She sure didn’t look too sick in the video. And who records a video if they are sick? It’s like calling in sick but sending your boss a picture of your healthy face.
Escándalo TV speculated that the real reason that Shakira didn’t show in Spain is because she wanted to avoid being asked about accusations of plagiarism that are currently being thrown at her by other musicians.
According to Univision.com:
A couple of days ago, Shakira was accused of plagiarism by salsero Jerry Rivera, who while not pressing charges publicly accused the Colombian singer of having used the trumpet arrangement on his song Amores Como el Nuestro in her latest hit Hips Don’t Lie.Jerry didn’t want to make the problem bigger, but in spite of not going to the authorities he called Shakira “indecent”.
“I love Shakira, but I don’t know if this is right. I think they should have asked the producer or the arranger, the owners of the music”, said Rivera in an interview with Telefutura.

Interesting, considering I saw the video today in which she says she had to cancel her visit to Europe. Is this like the Elvis sighting?
It’s confirmed here:
La X edición de los Premios de la Academia de las Artes y las Ciencias de la Música concedió esta noche el Premio Latino de Honor a la colombiana Shakira, ausente en la gala por la cancelación de su viaje a Europa, que valoró el premio como ‘doblemente especial al ser este año el décimo aniversario’.
Fue la propia cantante la que recordó, en un vídeo de agradecimiento al no encontrarse en España, a otros de los galardonados en pasadas ediciones como Juan Luis Guerra, Gloria Estefan y Ricky Martín, a los que ella definió como ‘grandes figuras de la música latina que además son mis amigos’.
La cantante justificó su ausencia ante una imprevista cancelación de su paso por varios países europeos prevista para estos días al tiempo que lamentó ‘la imposibilidad de estar con el público español tal y como quisiera’.

Of course he’s not taking any legal action, he’s not the only person that’s used that trumpet arrangement. I’ve heard it in at least 2 other songs before, one of them was “Deja Vu” by Lord Tariq & Peter Gunz. I also think it’s the opening music to the videogame ‘Magic Sword’.

Jerry Rivera is mentioned in the full credits for “Hips Don’t Lie”, and the entry reads:
Contains Excerpts from the composition “Amores Como El Nuestro” performed by Jerry Rivera, courtesy of Sony Discos.
It seems like Jerry Rivera himself is unaware that Sony Discos already gave Shakira and Wyclef Jean permission to sample the song. It could possibly be because Jerry Rivera did not even write the music to that song so he did not have to be contacted for permission. Shakira received approval from Jerry’s record label Sony Discos, which is under the major label Sony/BMG (that Shakira is on).
And now the whole plagiarism idea is proven to be wrong.

I read this article, then went over to Univision, read that article… and I listened to both songs. The trumpets are the same….
However… He does have full credits listed for the song so… why hasn’t this article been corrected? Are you trying to start a controversy where there is none?
I’m suprised the author of the article didn’t include what was further in Univisions article. That one may have caused more of a stir. Though, to find further evidence of it, a real reporter would have to look for corroborating stories.

Jerry Rivera had made a mistake, when he made the complaint he didn’t know that sony had given prior permission. If you look at the CD cover it even says on it:
